At the conclusion of the defence case, Judge Datuk Muhammad Jamil Hussin determined that the defence had succeeded in creating a reasonable doubt and made the decision accordingly.
Former radio DJ Ismahalil is exonerated of drug trafficking charges by the KL High Court.
The prosecution was unable to demonstrate that the defendant (Ismahalil) had control over and possession of drugs in a bag that was kept in a room of his rental home.
The judge stated, “The prosecution also failed to establish beyond a reasonable doubt that the accused had trafficked the drugs.” Ismahalil, 50, entered a not guilty plea to a charge of trafficking marijuana estimated to weigh 374.6g at a residence in Jalan Semarak, Wangsa Maju, on August 27, 2021, at 5:35 p.m.
Ismahalil was accused under Section 39B(1)(A) of the Dangerous Drugs legislation of 1952, and if found guilty, he would be subject to the death penalty under Section 39B(2) of the same legislation.
According to Muhammad Jamil’s assessment, the fourth prosecution witness (the investigating officer) failed to look into who had access to a room in the rental home and was unaware that the room belonged to radio presenters.
“I accepted the accused’s testimony that other radio hosts, crew members, and visitors of Bapakku FM (which runs in the residence) had access to the room. The testimony of four defence witnesses corroborated the accused’s testimony.

Not just the accused but other people can enter the room, according to the statement. This means that in addition to the accused, other people also have possession of and control over the drugs discovered in the room, the prosecutor added.
Muhammad Jamil claims that the fifth prosecution witness, a police officer, likewise affirmed that there were no personal items of the accused in the bag carrying the drugs and that there was no proof linking the bag to the accused.
“The defence and the testimony of four defence witnesses have raised reasonable doubts regarding the custody and control of the accused over the drugs,” he claimed.
In the hearings of today, Ismahalil was represented by attorneys Datuk Ahmad Zaharil Muhaiyar and Adi Zulkarnain Zulkafli, while deputy public prosecutor Noor Dayana Mohamad prosecuted the case.
