In his opening remarks, while introducing Johnny Depp, Benjamin Chew said: “Some of you may recognize Mr. Depp from watching him play characters like Edward Scissorhands or Captain Jack Sparrow from Pirates of the Caribbean films. For nearly 30 years, Mr. Depp earned a reputation as one of Hollywood’s most talented actors, a respected entertainer whose name became associated with box office success. Today a lie is associated with his name, a false statement by his ex-wife, the defendant Amber Heard”.
He added, “That fake cast of Mr. Depp falsely and unfairly characterized the cast, Mr. Depp, as the villain. A man who would violently abuse a woman.”
Benjamin then said: “This is a defamation case. It is a case of how devastating words can be when they are false and spoken publicly under the law, a person who makes a false statement about another person may be liable for damages resulting from that lie because words matter.”
He emphasized that the words “can cause strong emotions in listeners and cause irreparable damage to a person’s reputation.”
Benjamin also mentioned three statements that Amber wrote in her article on the washington post in 2018. In the first statement he cited, “I spoke out against sexual violence and faced the wrath of our culture. That has to change.”
He also highlighted statement number two. He shared: “Two years ago, I became a public figure representing domestic abuse and felt the full force of our culture’s anger towards women who speak out.”
A third statement read: “I had the rare opportunity to see, in real time, how institutions protect men accused of abuse.”
“Ms. He heard that you did not use Mr. Depp’s name in the signature,” Benjamin said loudly in court. “She didn’t have to.” She pointed out that two years earlier, on May 27, 2016, Amber had publicly accused Johnny of domestic abuse.
Johnny’s lawyer also talked about Amber going into court to get an ex parte restraining order, which meant that ‘Mr. Depp and his lawyer were not there and did not have a chance to be heard.”
